These Terms of Use (“Terms”) govern your use of the Cueframe iOS application and cueframe.iamdev.me (together, the “Service”). By using the Service, you agree to these Terms. If you do not agree, do not use the Service.
1. Eligibility
You must be legally able to enter into these Terms. If you use Cueframe on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes that organization.
2. License to use Cueframe
Subject to these Terms, we grant you a limited, personal, non-exclusive, non-transferable, revocable license to install and use Cueframe on Apple devices you own or control, consistent with the App Store rules that apply to you. We retain all rights in the Service not expressly granted.
3. Your content
You retain ownership of the titles, directions, scripts, recordings, media, captions, and other content you provide or create through Cueframe (“Your Content”). You grant us a limited license to process Your Content only as needed to operate, secure, and improve the features you request.
You are responsible for Your Content and for ensuring you have the rights and permissions needed to record people, use media, display trademarks, publish statements, and distribute the finished video.
4. Generated content
Cueframe can help generate ideas, drafts, hooks, and scripts. Generated content may be inaccurate, incomplete, repetitive, or similar to content produced for others. You must review and edit it before recording, publishing, or relying on it. Cueframe does not provide legal, medical, financial, or other professional advice.
5. Acceptable use
You may not use the Service to:
- Break the law, infringe intellectual-property or privacy rights, or violate another person’s consent.
- Create or distribute deceptive impersonation, harassment, exploitation, or unlawful harmful content.
- Probe, disrupt, overload, reverse engineer, or bypass security or usage controls of the Service, except where applicable law expressly permits it.
- Use automated means to extract or scrape the Service, or resell access without written permission.
- Upload malware or attempt unauthorized access to systems or data.
6. App Store terms
Apple is not a party to these Terms and is not responsible for the Service or its support. Your use of Cueframe must also comply with the Apple Media Services Terms and applicable App Store usage rules. If these Terms conflict with mandatory Apple terms, the mandatory Apple terms control to that extent.
7. Service availability and changes
We may update, improve, limit, suspend, or discontinue parts of Cueframe. Features that depend on network access or third-party services may be interrupted or changed. We do not promise that every feature will always be available on every device, language, region, or operating-system version.
8. Feedback
If you send suggestions or feedback, you allow us to use them without restriction or compensation, while you retain ownership of any underlying content you provide.
9. Disclaimer
To the fullest extent permitted by law, the Service is provided “as is” and “as available.” We disclaim implied warranties, including merchantability, fitness for a particular purpose, non-infringement, and warranties arising from course of dealing. We do not guarantee specific audience growth, engagement, income, accuracy, or publishing results.
10. Limitation of liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for loss of content, profits, goodwill, data, or business opportunities arising from the Service. Where liability cannot be excluded, our total liability will not exceed the amount you paid for Cueframe during the 12 months before the event giving rise to the claim, or USD 25 if you paid nothing. Some jurisdictions do not allow certain limitations, so parts of this section may not apply to you.
11. Indemnity
To the extent permitted by law, you agree to defend and indemnify us from claims, losses, and reasonable costs arising from Your Content, your misuse of the Service, or your violation of these Terms or another person’s rights.
12. Termination
You may stop using Cueframe at any time. We may suspend or terminate access if you materially violate these Terms, create risk for users or the Service, or where required by law. Provisions that by their nature should survive termination will survive.
13. Governing law
These Terms are governed by applicable law without regard to conflict-of-law rules. Nothing in these Terms removes consumer rights that cannot be waived in your place of residence.
14. Changes to these Terms
We may update these Terms. We will post the revised version here with a new effective date. Continuing to use the Service after updated Terms take effect means you accept them, except where additional notice or consent is required by law.
